If you receive an Office of Administrative Trials and Hearings (OATH) violation, formerly known as Environmental Control Board (ECB) from the Department of Buildings (DOB), you must correct the violating condition in a timely manner and submit the following documents for proof of compliance:

  • An original Certificate of Correction affidavit (AEU2 Form or AEU3321 Form)
  • Proof of correction such as  permits, photographs, receipts, inspection results, etc. and
  • A notarized statement (AEU20 Form) attesting to how the violation was corrected, if submitting an AEU2 form
  • Proof of payment of any applicable DOB civil penalties

Submitting Documents

The paper Certificate of Correction affidavit and statement forms can no longer be sent or delivered in-person.

To certify correction, submit the required documents to DOB's Administrative Enforcement Unit (AEU) in DOB NOW, use an eFiling account to login to DOB NOW and select the BIS Options portal.

If you don't have an account, you can create a new eFiling account. 

Register with eFiling.

DOB will assist you with submitting a Certificate of Correction.

How to Pay a Penalty

You can pay a penalty using CityPay.

Use CityPay to pay an OATH violation.

You must correct Class 1 (immediately hazardous) violations immediately. If the immediately hazardous condition is not corrected in a timely manner, you may be issued a DOB Violation with a $1500 civil penalty. The $1500 civil penalty is in addition to penalties assessed by OATH.
