In New York City, Local Law 1 of 2004 presumes lead-based paint could exist in dwelling unit and common areas if:  

  • The building was built before January 1, 1960; 
  • The building has tenant-occupied apartments; and 
  • A child under the age of six resides or routinely spends 10 or more hours in the dwelling unit.

The Department of Housing Preservation and Development (HPD) has many resources for owners and tenants including:

  • Sample documents for recordkeeping
  • Violation correction information
  • Webinars which help property owners to understand their responsibilities
  • Information about local laws related to lead-based paint compliance

You can get a copy of the "Fix Lead Paint Hazards: What Landlords Must Do and Every Tenant Should Know" brochure. The brochure includes information about landlord responsibilities in residential buildings with 3 or more units in which a child under the age of 6 lives.

Call 311 or 212-NEW-YORK (212-639-9675) to request a copy.

Building owners must send an annual lead and window guard notice to tenants in buildings with rental units.

Tenants must complete and return the form to the building owner before February 15, each year.

If the form is not returned, building owners are required to visit the apartment to determine if a child lives there.
