New City laws require many food delivery apps to have a license and establish rights for consumers, delivery workers, and restaurants.

Some rights take effect on January 24, 2022. The City can begin to accept complaints from consumers, delivery workers, and restaurants on January 24, 2022.

Other rights take effect later. Monitor nyc.gov/DeliveryApps for updates.

Consumers who use food delivery apps have new rights:

  • Apps must tell you that they collect your data and may share it with restaurants unless you opt out.
  • Apps must allow you to opt out of having your data shared with a restaurant.
  • Apps must tell you how much delivery workers get paid from a tip, in what form, and when.

If you do not opt out from apps sharing your data with restaurants, you have rights:

  • Restaurants must let you withdraw consent and delete your data on request.
  • Restaurants cannot sell, rent, or disclose your data without your consent.

  • Unlicensed apps
  • Apps that do not provide required disclosures
  • Restaurants that misuse your data

Workers who make restaurant deliveries for licensed apps (apps that take customer orders directly) have new rights:

  • Apps must tell you how much the customer tips for each delivery.
  • Apps must tell you your total pay and tips for the previous day.
  • You may have better access to restaurant bathrooms when you pick up orders.

Additional rights will take effect on April 22, 2022 and January 1, 2023.

  • Restaurants that do not provide bathroom access.

Restaurants that use licensed apps (apps that take customer orders directly for delivery) have new rights:

  • Apps must have a written agreement with your restaurant to list it on the app.
  • Apps that list or link to a phone number for your restaurant must include your direct phone number.
  • Apps must make clear to consumers that any additional listed phone number is for the app and confirm any fees to use numbers to place orders.
  • Apps must give your restaurant consumer data if you request it.
  • Apps cannot charge your restaurant for phone orders that do not end with a sale.
  • Apps cannot charge your restaurant more than the fee caps.

Beginning January 24, 2022, restaurants can file a complaint about apps that are unlicensed or that violate these rights.
