Smoke Free Air Act Complaint

The Smoke Free Air Act (SFAA) protects the health of New Yorkers against the harmful effects of secondhand smoke by banning smoking and the use of e-cigarettes in public spaces.

Public spaces include:

  • Businesses
  • Child or day care centers
  • Convention halls
  • Gym, health clubs, and other membership associations
  • Health care facilities
  • Libraries
  • Museums and galleries
  • Office buildings, factories, and warehouses
  • Parks
  • Public and private schools
  • Restaurants and bars (including outdoor dining areas)
  • Residential building common areas
  • Shopping malls and retail stores (other than retail tobacco stores)
  • Sports and recreational arenas
  • Theaters, concert halls, and auditoriums
  • Zoos

You can report:

  • Ashtray in a smoke free area
  • Smoking or vaping signage missing or inadequate
  • Workplace policy not provided or inadequate
